In response to the objection letter dated March 8, 2000 from Francis McCormick we would like
to state the following:
The McCormick's have anon-permitted and non-reclaimed gravel pit that they started in the early
nineteen seventies, and have periodically sold and removed material from that site.
The McCormick property boarders a gravel pit duectly south across State Highway 112, that was
started and operated by the State of Colorado around nineteen twenty two; thirty five years prior
to the McCormick's purchase of their property.
The pit that Kenny D. and Dana K. Smith own and is permitted and operated by Center Redi Mix
Inc., one half of a mile south of the McCormick's property, was started around nineteen twelve by
the City of Center; forty three years prior to McCormick's purchase of then property.
There aze numerous gravel pits within a few miles radius of the McCormick property. Frances
McCormick was sent a certified public notice in nineteen eighty six when Center Redi Mix Inc.
filed for their regular 110 Mining Reclamation permit # M- 86-135. In nineteen ninety two Francis
McCormick was also sent a certified public notice when Center Redi Mix Inc. filed then
conversion from a 110 to a regulaz 112 Mining Reclamation Permit # M-86-135. We would Wce
to note that Francis McCormick did not respond or object to either of our public notices during
their review periods.
There were special Planning Committee meetings and special County Commissioner meetings
scheduled regazding Kenny D. and Dana K. Smith's change of use permit for the property located
at 45247 Hwy. 112, Center, Colorado. The change of use permit from Agriculture to
Commercial-Industrial allowing Kenny and Dana Smith, to mine and place crushing, screening,
and handling equipment, and concrete and asphalt batch plants on this property, was unanimously
approved by both the Saguache County Planning Committee and the Saguache County
Commissioners.
