Dear Mr. Peterson,
Listed below are adequacy review comments on the above-captioned Regular 112 application. The
decision date for your application is scheduled for October 9, 2006. Therefore, I would appreciate a
response from you as soon as possible (Your response should include two (2) copies). Any public
comments that we receive on your application during the interim will be forwarded to you. Please be
advised that your application may be deemed inadequate and maybe denied on October 10, 2006 unless
the following adequacy review items are addressed to the satisfaction of the Division or an extension is
Sled prior to the submission date.
Permit Annlication Form
1, In the section for the description of amendment or conversion (item 16) you note that this is not a
conversion, that there is an underlying 111 permit onsite, and that you aze increasing the size of the
permit area and applying fora 112. You aze correct in that you cannot convert a 111 permit to a
112-type permit, however the comment about increasing the size of the permit area is confusing,
please clarify.
The method for handling this is to submit a new 112-permit application, and once the new permit
is issued, the 11 I Operator can then make a request for warranty release to the Division. The 112
Applicant should make a statement in the application that they will accept the responsibility for
reclaiming the 111 site. Also as part of the 112 application the Applicant must include a letter
from the 111 Operator that states that this 112 permitting over the existing 111 permit is
acceptable, please provide this letter [o the Division.
