Cattany <br />Division DIreClor <br />Natural Resource Trustee <br />RE: Adequacy Review Comments for the Ordway Pit, Regular 112 Application, Permit No. M-2006-054 <br />Dear Mr. Peterson, <br />Listed below are adequacy review comments on the above-captioned Regular 112 application. The <br />decision date for your application is scheduled for October 9, 2006. Therefore, I would appreciate a <br />response from you as soon as possible (Your response should include two (2) copies). Any public <br />comments that we receive on your application during the interim will be forwarded to you. Please be <br />advised that your application may be deemed inadequate and maybe denied on October 10, 2006 unless <br />the following adequacy review items are addressed to the satisfaction of the Division or an extension is <br />Sled prior to the submission date. <br />Permit Annlication Form <br />1, In the section for the description of amendment or conversion (item 16) you note that this is not a <br />conversion, that there is an underlying 111 permit onsite, and that you aze increasing the size of the <br />permit area and applying fora 112. You aze correct in that you cannot convert a 111 permit to a <br />112-type permit, however the comment about increasing the size of the permit area is confusing, <br />please clarify. <br />The method for handling this is to submit a new 112-permit application, and once the new permit <br />is issued, the 11 I Operator can then make a request for warranty release to the Division. The 112 <br />Applicant should make a statement in the application that they will accept the responsibility for <br />reclaiming the 111 site. Also as part of the 112 application the Applicant must include a letter <br />from the 111 Operator that states that this 112 permitting over the existing 111 permit is <br />acceptable, please provide this letter [o the Division. <br />6.4.1 EXHIBIT A -Legal Description <br />This section is adequate as submitted. <br />6.4.2 EXHIBIT B -Index Map <br />This section is adequate as submitted. <br />6.4.3 EXHIBIT C -Pre-Minine and Mining Plan Mao(s1 of Affected Land <br />1, Please include in the map or a unique map the boundaries of the 1 I 1 permit in relation to the <br />Office of Office of <br />Mined Land Reclamation Active and InaRive Mines <br />
