~ Section 8I6.111(a) Continued. <br />The seed mixtures identified will be applied to the affected lands <br />according to the procedures and in the amounts identified in Sec- <br />tion 780.18. <br />Refi'Mine"Aiea"Miictuie The seed mixture proposed for seeding at the <br />Kerr Mine Area is contained in Table 67, Kerr Mine Area Seed Mixture. <br />Refr Tipple Afea'Miictur@ The seed mixture previously approved by <br />CMLRD for the Kerr Tlpple Area and proposed for seeding at the Kerr <br />Tipple Area is contained in Table 68, Kerr Tipple Arsa Seed Mixture. <br />(b) All revegetation shall be in compliance with the plans submitted <br />under 30 CFR 780.18 and 780.23, as approved by the regulatory authority <br />in the permit, and carried out in a manner that encourages a prompt <br />• vegetative cover and recovery of productivity levels compatible with the <br />approved postmining land use. <br />(1) All disturbed land, except water areas and surface areas of roads <br />that are approved as a part of the postmining land use, shall be seeded <br />or planted to achieve a permanent vegetative cover of the same seasonal <br />variety native to the area of disturbed land. <br />(2) The vegetative cover shall be capable of stabilizing the soil sur- <br />face from erosion. <br />(3) Vegetative cover shall be considered of the same seasonal variety <br />when it consists of a mixture of species of equal or superior utility <br />for the approved postmining land use, when compared with the utility of <br />naturally-occurring vegetation during each season of the year. <br />(4) If both the premising and postmining land uses are cropland, plant- <br />ing of the crops normally grown will meet the requirements of Paragraph <br />(b)(1) of this Section. <br />816-144 <br />
