EnIIIPI'1' "('" <br />S~ <br />WATER INPORI9ATION <br />The applicant feels that this project caill he of little disturbance to <br />the prevailing water rights or hydrology of the area. Experience with <br />similar operations at other locations leads the applicant to believe <br />that no portion of the site will lie classified as "Wetlaiicis" Icy the <br />Corps of Ensineers. The pit area may be dewatered, and the necessary <br />NPDES Permit has already been issued. <br />Runoff will not be a problem from stockpiles or adjacent areas. Tlie <br />minimal drainage that occurs will be made to drain into the excavated <br />• pit area. Extraction will remain a minimum of- 100 feet froia the north <br />bank of the Arkansas P.iver. A flood protection berm approximately 2 <br />feet in height will. be constructed from overhurden on the west and south <br />pit perimeters nn tl~e setback area. <br />There is a minor drainage channel or arroyo which lies roughtly on the <br />north/south section line separating Sections 34 & 35. It will not be <br />disturbed during most of the project since the major area of excavation <br />lie:; west of it. As described in the llinin; Plan (Exhibit D), extraction <br />caill start ~aitli a t~ort']i to sout}~ pass on the caest, caitli each succeeding <br />pass moving, east. ldhen extraction nears the arroyo, it will be recl;anneled <br />into the abandoned Booth Ditch Canal right-of-way along the north boundary <br />of the permit area in Section 35, and discharged into t}ie Arkansas River <br />al' the east end of the permit area. <br />Tlie final configuration will contain one poiad with a maximum of 40 surface <br />acres after reclamation. Any excess overburden will be used to add <br />sinuosity to the shorelines and further reduce the pond surface acres, as <br />well as construction of the aforementioned flood control berm. <br />The applicant believes it is in compliance with existing federal. and state <br />water laws and regulations governing water and water rights. It is not <br />expected that this operation will cause measurable material injury to <br />senior caater rights. <br />• <br />
