The <br />violations were created by the previous operator and were <br />cleaned up by Hallett. Hallett had not even begun mining <br />when the Notice of Violation was issued. The quarry is <br />presently in compliance with MLRD regulations to the best of <br />everyones knowledge. <br />The violation issued for the Walker Pit was for <br />inadvertently parking mining equipment off the property. <br />The reason equipment was parked off the permitted property <br />was to cooperate with another property lessee, Waussensmith <br />Electric, that needed some work done on their lease. No <br />mining or stockpiling was done outside the permit boundary <br />and the violation was corrected as soon as it was brought to <br />Hallett's attention. <br />The alleged violation by Hallett on the McClain Pit is <br />simply that. Hallett is unaware of any violations and is in <br />the process of completing a boundary survey to check <br />compliance with the permit. <br />Additional Comments <br />The reference made to conflicting wildlife reports was due to a <br />misunderstanding <br />by the Colorado <br />Division of Wildlife in their <br />initial visit to <br />the property. <br />They originally <br />assumed we would <br />be mining on the <br />hillsides rather <br />than the top. <br />Their initial <br />report reflected <br />conditions in <br />an area that the <br />proposed mining <br />specifically stayed <br />out of due to <br />environmental <br />concerns. The <br />second wildlife <br />report reflects <br />the area that <br />will actually be <br />disturbed. <br />Rock Ridge Elementary PTO <br />All issues stated in this letter are not reclamation issues as <br />noted by Ms. Miller. We do plan to address the issues of noise, <br />dust and truck traffic at the local review level with Douglas <br />County. <br />
