Schrein~ • <br />June 15,2000 <br />Page 2 of 3 <br />in the area west of Brighton Road and north of First Creek, which is not <br />currently in the floodplain, and the addition of parcels to the floodplain <br />that could be created with this mining operation. The area being mined <br />appears to remove the northern bank of the First Creek floodplain, <br />which may cause negative impacts to the floodplain. Certainly during <br />the mining operation this opens the opportunity for storm flows to leave <br />the floodplain, thus creating the potential for an increased floodplain <br />designation and negative impacts to surrounding properties that may <br />be placed in an enlarged or relocated floodplain. With the reclamation <br />of the site after mining is completed this area should be restored to <br />insure that the floodplain limits are maintained, and that t_he First Creek <br />flows can be safely passed. <br />As a condition of approval, we request that at a minimum, this issue be <br />addressed through the Adams County Floodplain Development Permit <br />process. To resolve this issue, additional hydrological studies may <br />need to be conducted to determine the exact location of the floodplain <br />and the impacts this operation may have on it. If the floodplain is <br />revised then the appropriate process for revisions and changes to the <br />floodplain map should also be completed. <br />We cannot in good faith support any changes due to this mining <br />operation that would place additional properties in the floodplain, either <br />during its operation or after reclamation of the site. <br />The City also objects to the Tanabe Permit Application on the grounds <br />that the proposed future use is contrary to the Comprehensive Plan of <br />the City of Commerce City as required under the following section of <br />CRS: <br />34-32.5-115 Action by board-appeals. <br />(4) (d) The proposed mining operation, the reclamation <br />program, or the proposed future use is contrary to the <br />laws or regulations of this state or the United States, <br />including but not limited to all federal, state, and local <br />permits, licenses, and approvals, as applicable to the <br />specific operation. <br />Commerce City Comprehensive Plan, approved by ordinance in 1985 <br />designated the area between East 104'" and East 112'" Avenues and <br />Brighton Boulevard and US 85 for future residential and retail uses. <br />One development, Belle Creek, already has been approved for 1,000- <br />
