The area being mined
appears to remove the northern bank of the First Creek floodplain,
which may cause negative impacts to the floodplain. Certainly during
the mining operation this opens the opportunity for storm flows to leave
the floodplain, thus creating the potential for an increased floodplain
designation and negative impacts to surrounding properties that may
be placed in an enlarged or relocated floodplain. With the reclamation
of the site after mining is completed this area should be restored to
insure that the floodplain limits are maintained, and that t_he First Creek
flows can be safely passed.
As a condition of approval, we request that at a minimum, this issue be
addressed through the Adams County Floodplain Development Permit
process. To resolve this issue, additional hydrological studies may
need to be conducted to determine the exact location of the floodplain
and the impacts this operation may have on it. If the floodplain is
revised then the appropriate process for revisions and changes to the
floodplain map should also be completed.
We cannot in good faith support any changes due to this mining
operation that would place additional properties in the floodplain, either
during its operation or after reclamation of the site.
The City also objects to the Tanabe Permit Application on the grounds
that the proposed future use is contrary to the Comprehensive Plan of
the City of Commerce City as required under the following section of
CRS:
34-32.5-115 Action by board-appeals.
(4) (d) The proposed mining operation, the reclamation
program, or the proposed future use is contrary to the
laws or regulations of this state or the United States,
including but not limited to all federal, state, and local
permits, licenses, and approvals, as applicable to the
specific operation.
Commerce City Comprehensive Plan, approved by ordinance in 1985
designated the area between East 104'" and East 112'" Avenues and
Brighton Boulevard and US 85 for future residential and retail uses.
One development, Belle Creek, already has been approved for 1,000-
