Schreiner ~Ui~' - .; ).ODU <br />Environmental Protection Specialist <br />Division of Minerals and Geology, Room 215 ~` ~•.:,c.ior;piin2rals8Geolog~ <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Tanabe Pit Application for Regular (112) Construction Materials <br />Operation Reclamation Permit <br />Dear Tom: <br />The City of Commerce City objects to the Tanabe Permit Application on <br />the grounds that the impacts to First Creek are not addressed as <br />required under the following section of CRS: <br />34-32.5-116 Duties of operators -reclamation plans. <br />(4) Reclamation Plans and their implementation are <br />required on all affected lands and shall conform to the <br />following requirements: <br />(h) Disturbances to the prevailing hydrologic <br />balance of the affected land and of the <br />surrounding area and to the quality and <br />quantity of water in surface and groundwater <br />systems, both during and after the mining <br />operation and during reclamation, shall be <br />minimized. Nothing in this paragraph (h) <br />shall be construed to allow the operator to <br />avoid compliance with other statutory <br />provisions governing well permits and <br />augmentation requirements and replacement <br />plans when applicable. <br />According to the ALTA survey provided by the applicant, the southern <br />and eastern portions of Parcel B are located within the First Creek <br />floodplain limits. The information provided does not address how the <br />floodplain will be maintained during operations or restored after mining <br />has been completed. We are concerned with the potential for flooding <br />
