The Division is not required to hold a Reclamation Warranty for a municipality and an <br />estimate is not required. Please include a statement that by Rule an estimate and warranty <br />are not required by a municipality for reclamation of the site. This is for any public review of the <br />application. <br />a. The application has been modified to include this note under Exhibit E. <br />7) Per Rule 6.2.1(2)(b), all maps must be signed by the qualified person preparing them. Staff <br />notes no signatures on the submitted maps. Please provide maps with required signatures <br />and any corrections rf noted. <br />a. The Ciry's engineer has signed all exhibit maps. <br />8) A city water line is noted within text near the edge of the proposed permit area. Staff however <br />can not find the line on the Mining Map or noted as a man made feature within 200 feet. <br />Please clar'rfy that all utilities which by rule are considered man made structures are accounted <br />for within the 200 foot area and that proper notice as required will be forth coming. <br />a. The City has noted all utilities, including Qwest for phone, Comcast for cable and <br />Xcel for gas and electric. The City's Public Works Department is the applicant for this <br />permit and they are responsible for the water line. <br />9) Exhibit G, Right of Entry, is insufficient. Please provide a deed, title or tax record indicating the <br />land is owned by the City of Rifle. <br />a. A copy of the Garfield County recorded (#338080) plat of the U.C. Addition No. Two is <br />attached. The plat dedicated land to the City of Rifle in 1981. The plat has the <br />cert~cate of dedication and ownership that the parcel is owned by the City of Rifle. <br />10) Prior to any decision, staff will need proof of publication, an affidavit of publication and proof of <br />notice to all landowners and easements within 200 feet of the proposed permit boundaries. <br />a. A copy of the proof of notice is attached. Notice was made on June 1, 2007 in the <br />Glenwood Springs Post Independent.
