Please respond. <br />18. The applicant has mentioned that Tamarix and Russian Olive trees exist within the proposed <br />permit boundary. The Division has previously provided the DMG "Policy Memo on <br />Management of Tamarisk and Russian Olive trees at Permitted Mine Sites" and "Guidelines for <br />Noxious Weed Management Plans". Please revise the proposed weed management plan to <br />include specific treatment methods/strategies for each of the following species that occur on site: <br />Tamarix, Russian Olive, field bindweed, Canada thistle, and knapweed species. Please respond. <br />6.4.13 EXHIBIT M -Other Permits and Licenses <br />20. Review comments from the US Army Corps of Engineers indicate that a wetland delineation <br />for determination of jurisdictional wetlands will be required. Also, the applicant has noted the <br />presence of riparian habitat and wetlands within the area to be pennitted. Please provide a <br />wetland delineation in conformance with the COE requirements that verifies the presence or <br />absence of jurisdictional wetlands within or adjacent to the area(s) proposed for excavation. <br />Please respond. <br />21. The Division affirms the applicant has committed to submit a technical revision to the permit <br />if any of the other required permits specif ed in Exhibit M -Other Permits & Licenses, will <br />require a change in the proposed mining and reclamation plans as currently specified. Please <br />note that the Division reserves the right to determine, at the time of submittal, whether the permit <br />modification will need to be processed as a technical revision or an amendment to the permit. <br />Please respond. <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />22. Exhibit C-Mine Plan Map shows the location of a house within 200 feet (approximately 50') <br />from the Cell B excavation. hi accordance with Rule 6.4.19, please provide a notarized <br />agreement between the applicant and the person(s) having an interest in the structure, that the <br />applicant is to provide compensation for any damage to the structure. In the event a notarized <br />damage waiver cannot be obtained, please provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities occurring at the mining <br />operation. (The Division notes that the stability analysis referred to for the North Bank Pit was <br />prepared for the Mamm Creek site. The Division will not accept this analysis for the proposed <br />North Bank Pit unless the applicant can provide sufficient assurance that the geologic and <br />hydrologic conditions at both sites are nearly identical.) Please respond. <br />
