Is the applicant proposing to have a no disturbance setback between the mining <br />operations and the permit boundar}!~ In particular are there setbacks between the mine <br />operations and the access roads, and if so what aze the setback distances? Please see <br />comments in section 6.3.12 below. <br />3. Please provide a copy of the approved NPDES permit (if required) for dischaging the <br />water from the pit, or provide the Division sufficient process details on how water <br />quality standards will be met to achieve the approved standards. The Applicant's <br />response is adequate as submitted. <br />4. Please provide a copy of the stormwater permit (if required), or provide details about <br />controlling stormwater from running offsite. Particularly provide plan details for <br />keeping sediment laden water from running off the overburden piles and onto the <br />neighboring land. The ApplicanNs response is adequate as submitted. <br />5. Please provide an agreement between the Applicant and the owner of the ditch for <br />allowing water to be dischazged into the ditch. Please depict the location on a map <br />where mine water will be discharged. If water is discharged into a ditch that is unlined, <br />it maybe prone to erosion if the discharge rates exceed the catrying capacity of the <br />ditch. The applicant should submit documentation to the Division for review as to the <br />proposed maximum dischazge rate into the ditch and specifications as to how much <br />water the ditch can carry without experiencing erosion. The Applicant's response is <br />adequate as submitted. <br />6. Please provide a copy of the Substitute Water Supply Plan or the details of the plan <br />including the quantity of produced water, where the produced water will be discharged <br />to, and details about avoiding injury to existing water rights. Based on the response, <br />the Applicant needs to commit to not exposing or discharging groundwater until <br />after the Substitute Water Supply Plan is approved and a copy is provided to the <br />Division. <br />7. In accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify <br />and characterize the aquifer to be mined in or through. The Division also requests that <br />the applicant define or predict the cone of depression expected for any azeas to be <br />dewatered and dry mined during the life of the operation. The cone of depression <br />assessment should define, at a minimum, the horizontal and vertical extent of drawdown <br />expected. If during the assessment, the applicant detetmines that a drawdown will <br />occur offsite that may impact a current groundwater user, the applicant should explain <br />any mitigation measures to be implemented and trigger points that would put mitigation <br />measures into effect. Please characterize the aquifer further, such as depth, flow <br />direction, and permeability. Will there be a cone of depression as a result of <br />mining operations? Estimate the horizontal and vertical extent of this cone of <br />depression. <br />6.3.4 EXHIBIT D -Reclamation Plan <br />1. Because the use of a compacted liner still allows for seepage, it is expected that some <br />water will be in the pit. Based on the Office of the State Engineer (OSE) or Dam Safety <br />Branch criteria for allowable seepage for a lined water storage facility and estimated <br />precipitation onto the site, estimate the quantity of water that the pit would expect to <br />
