The Division's <br />comments from that review are listed below. Please respond to these comments as soon as <br />possible, or at least by April 15th, so that the May 2nd decision due date can be met. <br />Right off the bat, let me commend you for a well composed application package. It was thorough <br />and easy to review. <br />Exhibit C <br />1. The fence on the southern boundary is considered to be a permanent manmade structure <br />(unless it is dilapidated and non-functionall. Please submit a plan to ensure the stability of <br />this structure, or submit documentation of an agreement between CDOT and the USFS <br />regarding repair or replacement of the fence in the event that it is damaged. <br />2. CDOT indicates that the pit will operate on an intermittent status. Please submit the <br />information required by Rule 1 .13.7 for intermittent operations. Rule 1 .13.7 references Rule <br />1.13.5121 which lists the specific information required. Be aware that the annual reports for <br />this operation must indicate the condition of the pit at the time of cessation, what measures <br />have been and will be implemented to comply with reclamation and performance standards, <br />and CDOT's plans for resuming mining at this site. <br />Exhibit D <br />1. It appears that there will not be any overburden available for backfilling the highwalls. <br />Therefore, the Division assumes that the highwalls will be reduced to the proposed 3:1 <br />slopes by cut and fill methods. If this is the case, CDOT must commit to leaving a 30 foot <br />buffer zone between the highwall crest and the permit boundary to allow for the cut and fill <br />operation without affecting land outside the permit boundary. The 30 foot buffer is figured <br />by assuming a maximum 20 foot highwall reduced to a 3:1 slope approximately 60 foot in <br />length. With the cut and fill method, the lower 30 foot of fill will come from cutting the <br />upper 30 foot (horizontal distance) from the crest of the highwall. <br />
