Storm Exemption and Containment Requirements <br />Page 3 of the permit details the storm exemption and <br />containment requirements, based on the Federal <br />Register of December 28, 1979. <br />. B. Salinity <br />The permit[ee discharges to [he Colorado River Basin <br />and therefore is subject to the "Regulations for <br />Implementation of [he Colorado River Salinity Standards <br />Through the NPDES Permit Program." The regulations <br />• state that "the objective for discharges shall be a <br />no-salt return policy whenever practicable." However, <br />the regulations do provide alternatives to this. The <br />no-salt requirement may be waived in those cases v,here <br />the sal[ load reaching the mainstem of the Colorado <br />River is less than one ton per day or 350 tons per <br />year, whichever is less. <br />It has been determined by the Division that the facility <br />is essentially a "no-discharge" facility and, therefore, <br />falls under this waiver. <br />Monitoring, however, will be required on a quarterly <br />basis. <br />L. Best Management Practice (BMP) <br />Page 17 of the permit outlines requirements for Best <br />Management Practices, to address any future oil soills <br />at [he facility. <br />D. Reopener Clause <br />A BAT reopener clause is included on pane 12, so [ha[ <br />the permit can be r..odified if necessary, follo~.yina <br />promulgation of effluent Guidelines for the coal industry. <br />• In addition, permit modification may be indicated once <br />SPCC and/or Bt1P regulations become final and are in effect. <br />
