<br /> <br />Mr. John Jordan -2- July 18, 1995 <br />Tuttle Applegate, Inc. <br />persons having an interest in the structure that damage to the structure is to be <br />compensated for by the operator." <br />The operator must either demonstrate that the stability of such structures will not be <br />affected, or provide to the Division agreements with the owners of such structures which <br />comply with Section 34-32-115(4)(d). <br />Structures of concern include the landowner's home and associated buildings within the <br />southwest corner of the permit azea, Interstate 25, County Road 36, the power line along <br />the east side of the permit azea, the Box Elder Ditch (Arthur Lateral) and the irrigation <br />ditch adjacent to the north-south permit boundary on the east side of the permit azea. <br />On page ]0 of the application, it is stated that there are two ditches on the property used <br />to irrigate, that only the one on the west side will be affected by mining activity, and that <br />the property owners have no objection to the removal of this ditch. Please show the <br />location of these ditches on the Exhibit C - Premining/Mining Plan Map, and provide the <br />Division with a copy of an agreement between the landowner and the applicant that the <br />ditch may be removed. If the other ditch is within 200 feet of the affected land, the <br />applicant must also address the "200-foot rule" as it apples to this ditch. <br />The applicant must also provide an agreement with the owners of the Box Elder Ditch <br />(Arthur Lateral) demonstrating that the applicant may construct an access road crossing <br />over this ditch. <br />b. Please provide some additional information for the ProcessingBatch Plant azea. Will this <br />equipment be placed prior to mining and mined azound, placed on the bottom of the pit or <br />on the mined azea after it is backfilled? What measures will be taken to prevent ground- <br />water contamination by the asphalt materials and fuel tanks? Also, to compute <br />reclamation costs, the size and depth of the wash plant ponds is needed. Will these ponds <br />be placed in the shale bedrock on the bottom of the pit or on the natural or backfilled <br />surface? <br />c. On page 7 of the application, the operator states that some azeas may not be mined down <br />to bedrock and that to help suppress dust, Connel! will consider seeding these azeas. <br />Please commit to such seeding. <br />d. On page 7 under Toosoiling, the applicant states that the topsoil will be stockpiled for the <br />reclamation process. As required by Rule 6.3.3(1)(b), please provide the estimated depth <br />to which soil will be salvaged for use in the reclamation process. Also, please provide the <br />seed mix and rate of application for the fast-growing cover used on the topsoil stockpiles <br />to minimize erosion. <br />e. On page 6, the applicant states, "During phase 2 and 3 Connell will establish a visual <br />screen on the north and east sides. The screen will consist of a grass covered there [sic] <br />
