Banks and Gesso, LLC <br />Exhibit D -Mining Plan <br />The proposed mining plan for the Raindance project is designed to allow for minimal <br />augmentation and replacement of groundwater exposed during the operations of the <br />mine. There are two mining areas from which the aggregate reserves shall be removed <br />and they are referred to as East Mine (to be reclaimed to Raindance Reservoir #1) and <br />the West Mine (to be reclaimed to Surcharge Reservoir). The concept is to excavate a <br />perimeter trench and place the soil and claystone liner as quickly as possible to seal the <br />reservoir and establish a dry mine condition. <br />Phase I - Topsoil and Overburden Removal <br />Phase I of the mine operation is to remove the topsoil from both the East and West <br />Mines and stockpile the material along the north side of the East Mine. The stockpile <br />shall be placed such that the existing B.H. Eaton Ditch, which is between the Poudre <br />River and the north wall of the mine, shall not be impacted in an adverse manner. The <br />total volume of topsoil within the limits of both mining areas is estimated to be 36,670 <br />yd3. After completing the removal and stockpiling of the topsoil material, the overburden <br />shall be excavated level to the crest elevation of 4773'. Stopping the excavation at the <br />crest elevation prevents groundwater exposure and the need for augmentation. The <br />overburden material within East Mine shall be used to construct the haul road from East <br />Mine to Weld County Road 64. The volume of material generated with the removal of <br />the first phase of overburden material from East Mine is estimated to be 178,500 yd3. <br />The volume of material needed for the construction of the haul road is approximately <br />160,000 yd3. The surplus of overburden material shall be stockpiled adjacent to the <br />topsoil stockpile along the north side of East Mine. Phase I is expected to be complete <br />within approximately 6 months of commencing operations. Additional topsoil and/or <br />overburden reserves will be placed within the mining limits, if necessary. <br />Phase II(a) -Initial East Mine Excavation and Clav Liner Installation <br />Phase II(a) of the operation shall commence upon approval of the Substitute Water <br />Supply Plan (SWSP) and Gravel Well Permit by the State Engineer's Office. This phase <br />of mining involves the excavation of East Mine material within the limits of disturbed area <br />to shape the permanent cut slopes from existing grade to the final reservoir crest <br />elevation, as well as the excavation of a trench inside the limit of the mine.
