The applicatio n states that all
excavation will halt above the ground water table. If the following
conditions are met, we have no problems with the proposed o peration:
I
1. No permanent g round water lake may be created by this operation. A
well permit would be required if a permanent ground water lake is
created. Since the operation is in an over-appropriated basin, a
plan for augmentation approved in Water Court for lasses due to
Evaporation would be required before a well permit could be issued.
I 2. The applicant must have a legal right to all water used in the mining
operation for dust suppression and any other uses. This water must
be decreed for the proposed uses. We have no information in our
files concerning the Sedalia Water and Sanitation District. Without
additional information from the District, we cannot recommend
approval based upon this water supply.
Sincerely,
I ,~ ~ , .J-..~~
Hal D.
