(ii) The results of these decisions shall be formulated in Subsection 6.3.4 or 6.4.5.
Exhibit "E" of this application, of which this is a part, had all of these decisions formulated into what
the operator believes is an appropriate and workable Reclamation Plan.
3.1.3 Time Limit and Phased Reclamation
The operator will carry reclamation to completion a~th all reasonable diligence. No phasing as such
is proposed for this operation. Mining will move south and then north until the entire area has been
mined. As mentioned earlier, reclamation will be an ongoing procedure following tnining and
processing as closely as operationally feasible.
3.1.4 Public Use
Neither the operator or Lessor plan on opening the subject to public use. Such interference is not
needed on private rangeland or in a mining area.
3.1.5 Reclamation Measures -Material Handling
(1) Grading shall be carried on so as to create a final topography appropriate to the final land
use selected as the Reclamation Plan.
(2) When backfilling is part of the plan ...............................
No backfilling is proposed as the pit floor will daylight on the perimeters eliminating any need for
backfilling. There are no acid-forming or toxic materials that could be leached.
(3) All grading will be done in a manner to control erosion and siltation of the affected lands,
to protect areas outside the affected lands from slides and other damage. If not eliminated, all
highwalls, if any, shall be stabilized.
There will no ltighwalls or potential slide areas in this operation.
(4) All backfilling and grading shall be completed as soon as feasible after the mining process.
The operator shall establish reasonable timetables consistent with good mining practices and
reclamation procedures.
As stated earlier, there will be no backfilling. Grading will be performed as reasonably consistent
v<~ith mining, stockpiling, and equipment movement. Reclamation will follow mining as closely as
operationally feasible.
