• <br />Mr. Humphries then explained the dif(crence benvicen Citizen and 'arty status as it relates to Board Hearings. (See <br />Party Status Memorandum attachment). Party Status is automatically granted to objectors to an application unless <br />they withdraw themselves from this status in writing. He noted the need for a written lever asking for withdrawal of <br />Party states, should Mrs. Boddicker merely wtsh to appear as a concerned citizen at the Board Hearins. He then drew <br />her attention to the form authorizing another person as a RepresenCttive of a Parry. and the need for it to be submitted <br />should anyone else wish to attend the meeting and testify in place cf the Boddickers. <br />The separation of jurisdiction between the State and the County way explained. The County has authority over all <br />land-use issues, and usually requires a Special Use permit for minine activities. The County has jurisdiction over <br />noise, traffic, and dust concerns, as well as all final zoning questior s, and the Slate has no input into this process. The <br />Division of Ivlinerals and Geolosy (DMG) has authority over issue~~ pertaining to reclamation of the site to a <br />designated end land-use, and the Operator's ability to complete the proposed reclamation, and also requires a <br />financial warranty or bond be posted for all proposed work. If an Operator is unable to complete reclamation, the <br />Division will step in and use the posted bond [a complete the previously approved reclamation. The Office of the <br />State Engineer (OSE), the Colorado Department of Public Health a td the Environment (CDPHE), and various other <br />agencies also have jurisdiction over different mining activities and :oncerns. <br />The meeting was adjourned at 2:OOpm. <br />Any concerns raised orally at this meeting that were not previously submitted in writing to the Division, must be <br />submitted in a written statement to DMG within five (5) working d;tys of the Informal Conference, in accordance <br />with Rule L4.6(2)(b). <br />Any Parties wishing to change or confirm their status before the Board Hearing are advised to submit [he attached <br />Party Slalus Request form prior to June 14, 1999. We would appreciate prompt attention in this matter, so that we <br />may plan ahead For the June Board Hearing, <br />The Pre-Hearing Conference, the next step in preparing for [he Mined Land Reclamation Board Hearing, is expected <br />to be held on either June 14 or 15, 1999 in Room 318, 1313 Shermt.n Street, Denver, CO. The exact date will depend <br />on who is appointed as Pre-Hearing Conference Officer for this application at [he May Board meeting.
