Schatz <br />January 12, 2001 <br />page 2 <br />not consider the concrete lined drainage channel to fall under Corps jurisdiction. <br />However, both the Last Chance Ditch and the seep ditch fall under the jwisdiction of the <br />Corps. The Last Chance Ditch and the seep ditch appeaz to contain all three criteria <br />necessary to fall under Corps jwisdiction. <br />Two ponds aze located within the Lohman property. The fast pond is located in the <br />northeast comer of the south hayfield. The second pond is located in the southeast corner <br />of the lower cow pastwe. Both fall under the jwisdiction of the Corps, as waters of the <br />United States. <br />Jurisdictional Wetlands <br />Regulated jurisdictional wetlands encountered in Colorado include submergent, <br />emergent, wet meadows, sloughs, swface water drainage ditches, bogs, and potholes. <br />Within the Lohman property, potential jwisdictional wetlands were observed within <br />pockets in the south hayfield and the cow pastwe southeast of the Lohman residence. <br />Within the French property, potential jwisdictional wetlands were observed within a <br />triangle at the southwest property boundary. Jwisdictional wetlands continue from this <br />triangle along the ditch that runs north parallel with the road that sepazates the properties. <br />Preble's Meadow Jumping Mouse Habitat <br />The Preble's meadow jumping mouse (Zapus hudsonrus preblei~ is a federally listed <br />threatened species which generally occurs neaz wetlands and water bodies. Currently, the <br />U.S. Fish and Wildlife Service (USFWS) and Corps are requiring habitat assessment <br />and/or live-trapping surveys for all projects in potential Preble's habitat. The property <br />was evaluated for potential Preble's habitat, based on the current USFWS guidelines. No <br />potential Preble's habitat was found within the properties. <br />Ute Ladies-tresses Orchid Habitat <br />The Ute ladies-tresses orchid (Spiranthes di/uvralis) is a federally listed threatened plant <br />species characteristically found in wet meadows and alluvial flood plains below 6500 feet <br />in northern Colorado, southwestern Wyoming, and the Uintah Basin of Uta1L Habitat <br />assessments and/or pedestrian surveys during the blooming period are required for sites <br />within the South Platte River 100 yeaz floodplain and in characteristic habitat which <br />includes azeas with a seasonally high water table, wet meadows, stream channels, <br />floodplains, azeas with vegetation in the facultative wet or obligate classification, and <br />jwisdictional wetlands. Potential critical orchid habitat was identified within the <br />potential jwisdictional wetlands located at the Lohman property within the south hayfield <br />and the cow pastwe located southeast of the Lohman residence. <br />
