Box 841 <br />Canon City, Colorado 8121 'L <br />kE: Fremont Paving and Redi-Mix, Inc. <br />FILE NU.: 8U-224 <br />Dear Mr. Lee: <br />In reviewing your application the followiny points need to be addressed <br />by September 18, 1983 so that your response can be incorporated into <br />staff's presentation to the Board on the September 21-22, 1983 meeting. <br />'The following points need to be addressed: <br />Exhioit E - Reclamation Plan <br />(1) In discussions with the consultant, staff has concluded that it is <br />not necessary to yrant relief from the section of the regulations <br />that speak to reclamation completion within five years. (Rule (i and <br />Section 116(1)(r) of the Act.) The operator intends to keep portions <br />of phase 1-3 in operation over the life of the mine, as a working <br />floor and storage area. With this intent in mind, the staff requests <br />that you submit a revised plot map (Exhibit B-3) that sets out the <br />areas referenced in phase 1-3 that will not be reclaimed until final <br />reclamation. This map will in turn be used to plot your reclamation <br />timetable and aid in defining lands applicable for bond release. <br />(2) Rule 2.12(5)(b) states "in those instances where the post-mining land <br />use if for...residential...and such use is not reasonably assured a <br />plan for reveyetation shall be submitted. Nppropriate evidence <br />supporting such reasonable assurance shall be submitted." Since no <br />such evidence was supplied to substantiate your end use of <br />residential land, please supply the staff with the re vegetation plan <br />for the areas in question. <br />(3) It is staff's understanding that irrigation will only be used for <br />re vegetation establishment.
