Rev., Lohmarui Sand & Grovel, File No. M-1001-017 <br />May 30, 1001 <br />Page 1 <br />3) On page 17 of the application, Exhibit G-Water Information, it is stated that a Temporary <br />Substitute Supply Plan (TSSP) will be submitted to the Colorado State Engineer at the <br />Division of Water Resources for approval. <br />Please commit to not exposing any groundwater or utilizing any groundwater for <br />wnsumptive uses until the applicanUoperator provides the Division with evidence that the <br />applicanUoperator is in compliance with the Office of the State Engineer's requirements <br />regarding groundwater use. <br />4) On page 31, Exhibit S-Permanent Manmade Structures, the applicant provides a commitment <br />to stay at least 200 feet away from all permanent manmade structures until such time that aJ <br />the applicant provides a notarized agreement between the applicant and the person(s) having <br />an interest in the strucurre that the applicant is to provide compensation for any damage to <br />the srnrcture, or bJ where such agreement cannot be reached, the applicant provides an <br />appropriate engineering evaluation demonstrating that such structure shall not be damaged <br />by activities occurring at the mining operation. <br />Please commit to providing all agreements obtained and all evaluations of stability to the <br />Division, prior to any disturbances within 200 feet of any permanent manmade structures, and <br />to providing updated maps showing the areas where such disturbances closer to 200 feet of <br />such structures will take place. <br />5) When the Division receives the additional clay liner and slurry wall information, the Division <br />may consider the information to be a revision to the application and may revise the current <br />June 18, 2001 decision date -see Rule 1.8.4(2). As an alternative, the applicant may waive <br />their right to a decision by June 18, 2001 and request a new decision date. <br />The Division anticipates receiving your responses on or before June 18, 2001. Please note <br />that Rule 1.8. I states that changes and additions to the permit application must be filed with <br />the Division and the County Clerk and Recorder.
