I will also respond to items we discussed on <br />the phone and items you faxed for my review. <br />1. it is not unusual to have a narrow setbacks from the dig <br />line to the permit boundary. But to do this the operator <br />has to maintain a larger setback during mining so if <br />cut/fill sloping is needed, there will be room to create the <br />slope. However we do not plan to cut/fill the exterior <br />slopes so no additional setback will be necessary. Since <br />sloping is done as mining progresses the operator realizes <br />they will have to stay within the Hermit boundaries and take <br />whatever precautions necessary to accomplish the sloping. <br />Thank you for your suggestion but we will only commit to not <br />mining within 15 feet of the permit boundary. <br />2. I disagree with your assessment on the need to do a Techni- <br />cal Revision (TR) when we wish to make minor changes to the <br />operation, if we state that possibility in the original <br />application. However, I understand that the Division does <br />not review each and every annual report so we will commit to <br />filing TR's if the seed mix is changed and if we mine deeper <br />that shown on the maps. <br />DIVISION OF WILDLIFE LETTER <br />I'm not sure how they could state there is extensive mining <br />on the site now. I think Mr. Briggs is confusing the Weathers <br />site with one operated by Western Pork Products, Corp. From what <br />I can tell they are removing a limy clay from a site just south- <br />
