;,- ~. w <br />.-, <br />~~ <br />Rationale for Recommendation for Approval, Over Objections <br />Regular 112 Construction IVlaterials Permit Application, <br />All Rite Paving and Redi-h1ix, North River Pit, File No. hI-99-005 <br />Submitted June 8, 1999 <br />Introduction <br />On June 2, 1999, thz Division of Minerals and Geology (DIG) issued its recommendation for approval, over <br />objections, of All Ritz Pavine and Redi-Mix's 112 reclamation permit application. This document is intznded <br />to explain why the Division was able to recommend approval over various issues of the one rzmainina <br />objecting patty. <br />All Rite Paving and Redi-Mix's North River Pit application was found complete and considered filed with the <br />Division on February 5, 1999. The application proposes to mine sand, gravel and borrow material at a site <br />located about 1 mile nottheas[ of La Junta, Colorado. A proposed 80-acre sand and gravel operation is to be <br />located just east of an area known as North La Junta and 200 feet North of the Arkansas River. A proposed 15 <br />acre borrow extraction area would be located''/x mile south of the sand and gravel site, south of the Arkansas <br />River, and''/z mile east of La Junta. <br />The applicant plans to wet mine the sand and gravel using a dragline to extract the resources. The sand and <br />gravel will be screened and stockpiled on site. Any asphalt hatching of these materials will occur at the <br />applicant's plant east of La Junta. There will be no fuel storage facilities on site. The applicant plans <br />contemporaneous reclamation as mining proceeds. The final land use is planned to be wildlife habitat, <br />including a lake supplied by groundwater. <br />The borrow material site will be mined using conventional truck loader methods. No processing will be done <br />on site. This area will also be reclaimed to wildlife habitat upon completion of mining. <br />All Rite-Paving and Redi-Mix has obtained the legal right-to-enter the property and conduct the proposed <br />mining operations through an agreement with the owners of both the surface and the mineral rights, John L. <br />Ary and John P. Ary. <br />I.Objections: <br />The Division received comments on the application from six individuals or couples, all of which were <br />contacted to determine whether they were objecting to the application and wanted party status during the <br />hearing process. All but one has stated to the Division either verbally or in writing that they do not want party <br />status. These individuals are no longer considered objectors with parry status. Their issues are no longer being <br />considered possible hearing topics, but are being considered as comments for review purposes. <br />Mr. Greg A. and Mrs. Debbie Storey, submitted, on March 26, 1999, comments regarding the application. Mr. <br />Storey stated to the Division on June 3, 1999, that they want their letter to be considered an objection to issuance <br />of a permit. They have parry status and their issues are listed below with the permit exhibids they relate to. A <br />Division response follows each issue listed. <br />
