<br /> <br />second ppv ground motion and 129 dbi air blast). <br />These same blasting standards will be a requirement in the new 1 12 permit. <br />Dust is not the DMG's jurisdiction. The Department of Health regulates dust problems. The Air <br />Pollution Control Division has been notified of this new application and will deal directly with <br />the applicant. <br />Noise is generally regulated by the County. However, since this is a historic mining area there <br />may not be any zoning laws for noise. You may want to check County Zoning for this area.ln <br />addition, the beeping noise you hear is a safety device that is required by the Mine, Safety and <br />Health Administration (MSHA). The device warns anyone in back of the vehicle that the vehicle <br />is in reverse gear and will be moving backward. As mining operations progress eastwazd along <br />the waste dump, the equipment will actually move nearer to your property unless the company <br />would agree to either leave the equipment where it is or move it farther away. Since noise is not <br />regulated by the Division, we cannot dictate where the equipment should be located. <br />Riparian habitat is also a concern of the Division. The area you delineated is not going to be <br />mined so, therefore, it should not be adversely affected. Again, all of the mining activities will <br />occur south of the river (except for the access road). <br />You are correct, there are numerous areas in and around the monarch quarry site that have some <br />vegetation. However, CLC is only obligated to revegetate those areas that are currently vegetated <br />and that will be disturbed by their mining activities. When CLC removes the limestone waste <br />material, they will have reclaimed a very large azea that CF&I was supposed to reclaim (this <br />material was supposed to be removed as part of CF&I's reclamation plan). Since [he dump area <br />is unvegetated, CLC will not be required to revegetate it. This also applies to the limestone and <br />dolomite areas. ff CLC disturbs areas that are currently vegetated, they will be required to <br />revegetate those areas. <br />Historic preservation is regulated by the Colorado Historical Society (CHS). They have been <br />notified of the new application and will deal directly with the applicant. <br />Thank you for submitting your comments and concerns. A copy of your letter was forwarded to <br />the permit applicant who was instructed to submit a separate response. <br />I should also point out that your comment letter was received a day after the comment period <br />expired (it expired at 4:OOpm on December 18, 2000) so the Division will not schedule the <br />approval of the application before the Mined Land Reclamation Board nor will an Informal <br />Conference or Pre-hearing Conference be scheduled. <br />If you have any questions, please give me a call. <br />
