times. have the right to examine the property, review and audit the records of the Lessee and to <br />verifi any information by contacting lessee account holders. <br />RIGHTS OF LESSOR: <br />It is agreed and understood that Lessor shall, at all times during the term of this <br />agreement, hate the use of any and all parts of the above-described property for any and all <br />purposes (except the production and removal of sand or gravel) except those portions actually <br />being occupied and used by Lessee for the production and removal ofsand or gravel as provided <br />in this agreement. Lessee, however, shall have the right of ingress and egress to and from the <br />above-described property to be used by Lessee. Lessee shall coordinate its use of the premises <br />with Lessor and his representative. Lessee will arrange for construction and maintenance of <br />fence around the site to prevent access to the same by the cattle pastured upon the premises of <br />the Lessor, if such fence is felt to be necessary by Lessor or his representative. <br />PER~4ITS: <br />Lessee shall take all steps to arrange for permits for mining, crushing, washing. <br />distributing and hauling its product upon and from the premises and shall pay all costs for the <br />same and fully comply with all of the provisions, terms and conditions of all laws, whether <br />federal, state or local and orders issued thereunder which may be in e8ect during the period of <br />this Lease relating to the operations of the Lessee under this Lease and the marketing of an}' <br />product thereof and any requirements for reclamation of the property imposed by the State of <br />Colorado or any federal, state of local entity. On termination of the Lease, the Lessee agrees to <br />reclaim and restore the premises to the site which meets the requirements of the State of <br />Colorado and any bond required for the same shall be posted by Lessee at Lessee's sole cost and <br />expense. <br />Rules and regulations as set forth by the Colorado Mined Land Reclamation Division for <br />recot ery' and restoration of mined land will apply where applicable to the lands lease herewith. <br />The Lessee shall have the right of ingress and egress to and from the subject premises and <br />to erect am temporary' structures, such as screening, crushing and/or asphalt or concrete plants: <br />to stockpile material in an area of sufficient size; and to employ any reasonable methods for the <br />removal of said material. The Lessee shall also have the right of ingress and egress for the <br />purposes of reclamation. All improvements and fences installed by the Lessee during ther term <br />
