<br />Colorado. A copy of the map showing the location of the same is attached hereto as Exhibit A <br />and by this reference incorporated herein. <br />Lessor warrants that Lessor is the owner of the above-described property and has the <br />right to conveti' and Brant the rights and privileees provided in this agreement. <br />EOUIPAIENT USED: <br />Lessor further grants to'Lessee the right to use all or any portion ofthe above-described <br />property for the purpose of erecting any and all equipment and temporary structures that may be <br />used by licensee in the production ofproduct as authorized herein and the right to grade roads or <br />rights of way to any and all points on such property necessary or usefitl in the production and <br />removal ofproduct from such property. <br />PRODUCT: <br />Lessor grants unto Lessee the right to remove the following product only from the <br />premises: <br />Sand, gravel, interbedded sandy clay and topsoil for production of sand, gravel. <br />aggregate, decorative rock, base course, pit run and rock chips and topsoil to the extent <br />not required for reclamation of the property. <br />Lessee acknowledges and agrees that Lessee has no rights to remove any other trtinerals or any <br />material containing same from the premises. <br />CONSIDERATION: <br />As consideration for this Lease, the Lessee shall pay to the Lessor the sum of One Dollar <br />($1.00) per ton of 2.000 pounds ofproduct. Lessee shall furnish Lessor with monthly records of <br />specific material produced and removed from the premises within five (5) days of the close of <br />each month and at the time of same shall tender payment to the Lessor for materials removed at <br />the rate provided of eontr_ ip~ntrlAL per ton. <br />On or within five (~) days of the last day of each calendar month during the term of this <br />lease, Lessee shall make a written report to Lessor and his representative in which shall be <br />entered and set down the exact amount in tons of all material removed from said premises during <br />the preceding month. This should include specific categories of material removed (sand, chips, <br />topsoil, decorative rock, etc.). In addition, reports of all materials crushed, washed, sorted, <br />screened or othern ise produced will be given to Lessor and his representative. Lessor shall, at all <br />
