Upon
review of the specifics of the complaints listed, it appears that some clarification is warranted.
DMG regulates reclamation aspects of mining operations. The applicant must demonstrate that
the proposed gravel pit site can be reclaimed to a beneficial use and they must indicate how
mining and reclamation will be performed to result in the proposed post-mining land use. Prior to
issuance of a permit, DMG requires the applicant to post a reclamation bond in an amount that is
adequate to reclaim the site, per the requirements of the reclamation plan.
Your concerns addressing:
• Traffic volume;
• Traffic safety on local roads:
• Noise pollution;
• Air pollution;
• Property values;
• Vibration;
• Aesthetics
do not appear to fall under the jurisdiction of DMG. These concerns, with the exception of air
pollution, are typically under the jurisdiction of local government such as Montrose County. Air
pollution is typically regulated by the Colorado Department of Public Health and Environment -Air
Pollution Control Division. Please be aware that DMG and the Mined Land Reclamation Board
IMLRB) cannot restrict, or require an operator to perform or modify, activities that are not under
our jurisdiction. It is suggested that you contact these agencies regarding your concerns specified
above.
Protection of groundwater resources does fall under DMG jurisdiction. The applicant has been
forwarded a copy of your concern and has been asked to submit a response. Currently, the
application specifies that groundwater resources are not to be exposed during the operation.
Additionally, DMG will require that all hazardous materials stored on site be stored in an adequate
spill containment structure.
As a result of the filing of an objection to this application, DMG's rules and regulations require
that we initiate a process of two public conferences and a Formal Public Hearing (see enclosure).
