U <br />review of the specifics of the concerns listed, it appears that some clarification is warranted~'PO,j~y <br />DMG regulates reclamation aspects of mining operations. The applicant must demonstrate that <br />the proposed gravel pit site can be reclaimed to a beneficial use and they must indicate how <br />mining and reclamation will be performed to result in the proposed post-mining land use. Prior to <br />issuance of a permit, DMG requires the applicant to post a reclamation bond in an amount that is <br />adequate to reclaim the site, per the requirements of the reclamation plan. <br />Your concerns addressing: <br />• Traffic routing; <br />• Traffic safety on local roads: <br />• Impacts to local roads <br />• Noise pollution; <br />• Air pollution; <br />do not appear to fall under the jurisdiction of DMG. These concerns, with the exception of air <br />pollution, are typically under the jurisdiction of local government such as Montrose County. Air <br />pollution is typically regulated by the Colorado Department of Public Health and Environment -Air <br />Pollution Control Division. Please be aware that DMG and the Mined Land Reclamation Board <br />(MLRB) cannot restrict, or require an operator to perform or modify, activities that are not under <br />our jurisdiction. It is suggested that you contact these agencies regarding your concerns specified <br />above. <br />Protection of groundwater resources and permanent man-made structures, such as irrigation <br />ditches, does fall under DMG jurisdiction. The applicant has been forwarded a copy of your <br />concern and has been asked to submit a response. Currently, the application specifies that <br />groundwater resources are not to be exposed during the operation. Additionally, DMG will require <br />that all hazardous materials stored on site be stored in an adequate spill containment structure. <br />The application specifies a 200 foot buffer zone will be maintained between the Gurley Ditch and <br />the mining operation. The applicant will be required to submit a damage waiver for any irrigation <br />ditches within 200 feet of the area to be affected. If the structure owner refuses to enter into a <br />damage waiver agreement, the applicant must either submit an engineering demonstration of <br />stability for the structure, or keep mining operations at least 200 feet away from the structure. <br />
