-n _.- :. <br />-B- <br />EXHIBIT F - Source of Legal Right-to-Enter <br />You must provide a description of the source that you base your legal right to <br />enter the site and conduct mining and reclamation. This could be a copy of <br />the lease, deed, abstract of title, or current tax receipt. A statement <br />acknowledged by a notary public that the operator has legal right to enter and <br />mine is also acceptable. <br />EXHIBIT G - Local Government Approval' <br />In accordance with 34-32-115(4)(e), the Board must make a finding that the <br />operation will be in compliance with local zoning or subdivision regulations. <br />You should submit information demonstrating that local government approval is <br />pending or will be considered within a short time. <br />Performance and Financial Warranties <br />You must submit a performance warranty and a financial warranty in an amount <br />determined by the Board prior to permit issuance.* Several different types of <br />financial warranty are allowed by the law. You should determine what type of <br />financial warranty you desire to use and obtain the appropriate forms from the <br />Mined Land Reclamation Division during the application review period to <br />facilitate finalization of an acceptable financial warrant; and permit <br />issuance. <br />Compliance With Other Laws <br />Section 115 of the Act requires a permit application be in compliance with all <br />applicable local, State and Frderal laws. We suggest you contact the <br />following agencies to determl~e whether you need to comply with their legal <br />requirements: <br />State Engineer with regard to the administration of water rights; <br />Colorado Department of Health with regard to the discharge of pollutants <br />into the waters of the State; <br />Colorado Department of Health with regard to the need fora fugitive dust <br />permit; and <br />U.S. Army Corps of Engineers regarding a dredge and fill permit. <br />* If the applicant is a unit of State or county government, then only a <br />performance warranty is required. <br />(Rev. 7/86) <br />2821E <br />
