STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
Gg~ /~~~r
FAX: (303) 832-8106
November 30, 2006 t/
Marvin Moore
1570 Ranney St.
e..~r_r~ I^..~
~? ,, .n .
Utl; 0 4 2006
Divisior; o: F,r,;;)a1'ation,
Mining and Satety
Craig, Colorado 81625.
.~
Re: State Pit #38, 11 Zc Application No. M-2006-076, Preliminary Adequacy Review.
Dear Mr. Moore,
COLORADO
DIVISION OF
RECLAMATION
MINING
- &-
SAFETY
Bill Owens
Governor
Russell George
Executive Director
Ronald W. Cottony
Division Director
Natural Resource Trustee
The Division of Reclamation, Mining and Safety has begun the review process for the above referenced
112c permit application. A Preliminary Adequacy Review has been completed. Please address the
following issues that either need correction or clarifications:
1) It is appears that the Bureau of Land Management has not been notified as a landowner within
200 feet of the proposed operation. Staff notes a four wheel drive trail is mentioned in the text of
the Mining and Reclamation Plans. Please supply the Division with documentation of proper
notice and approval by BLM for the relocation of the trail. The relocation should be shown on
the Mining Map C-4.
2) The Division will require documentation of consultation with the Anny Corp of Engineers
concerning the drainage impacts. It appears that there are no issues. However, should there be
concerns by the Corp and requirements to mitigate those concerns; it could require a Technical
Revision, additional costs to the County and or delays in approval of this application.
3) It is noted in the Mining and Reclamation Plans that the overburden will be protected from
erosion. However, no specific measures are noted. Please clarify what possible measures will be
taken to prevent the loss of overburden to wind and precipitation.
4) In the Reclamation Plan it is noted That some roads may be lefr in place for the ]and owner. The
Division needs more definitive information. Staff suggests stating al] roads will be left un-
reclaimed unless specifically directed by the land owner to do otherwise. That way, any roads
that are reclaimed are above and beyond the approved plan, but it gives the County and
landowner some latitude and discretion.
Office of Office of
Mined Land Reclamation Active and Inactive Mines
