During most of the time from then until now the pit <br />operation has remained under the name of Greeley Sand & Gravel. It <br />is now changed, and we hereby notify the t4LRB of this action. Upon <br />approval of the Board the $11,500 bond on this property will be assumed <br />by MPM as well as the obligations for reclamation of the affected land <br />as set out in the approved application. We have one technical revision <br />to request that is based on new data obtained since the original permit <br />was granted. <br />This technical revision neither increases nor decreases the <br />acreage of affected land. It does not have a significant affect on <br />reclamation. <br />Greeley Sand and Gravel Co. inadvertently expanded phases one <br />and two into and mined parts of phases seven and nine. This area of <br />the mining plan needs to be revised {please see included map). <br />When the original map mining plan and reclamation plan were <br />prepared, it was planned that each phase would be excavated in one or <br />more small areas that would vary in size from 6.4 acres near the river <br />to 24 acres away from the river. It was the opinion of the operator <br />that these areas were the maximum sizes that could be dewatered to <br />permit in-pit operation. This procedure would have created 12 plus <br />ponds. It is not clear how many ponds would have been created in <br />phase nine. In addition, this method would have lest over three <br />quarters of a million yards (over 1,000,000 tons) of what we now know <br />is extractable sand and gravel in the useless dikes between ponds. <br />This would be in conflict with Section (1)(g) of 39-1-304 CRS 1973 <br />that calls for "Maximization of extraction of commercial deposits" in <br />plans for extraction. <br />No changes will be made to the exterior boundaries of the affected <br />land. Shape, set backs, slopes and revegetation will remain as approved <br />
