<br />EXHIBIT D <br />Cheyenne County agrees with assignment and that the operator will fully <br />comply with SCS Reclamation Plan specifics. <br />Rule 6.3.4 (a). overburden will be replaced when there is a sufficient area <br />affected, usually 3-4 acres. <br />Rule 6.3.4. (c)(I). Thickness of plant growth medium to be replaced. All <br />overburden and topsoil stockpiled will be replaced for plant growth medium. <br />6" of topsoil and overburden will be used throughout the pit for reclamation. <br />Rule 6.3.4 (e). No loading area road, no berm, no catch pond. <br />EXHIBIT E <br />Rule 6.3.5 (1). No loading area road, no berm. All mining activities <br />conducted by the operator will be within the pit boundaries. Map will be <br />amended. <br />Rule 6.3.5 (2)(b). Map will be amended to include adjacent landov.~ners <br />within 200' and make notation of barbed wire fence. <br />Rule 6.3.5 (2)(c). No catch pond. <br />EXHIBIT F <br />Rule 6.3.6. Permit application will be sent to Colorado Department of <br />Public Health and Environment. Catch pond is no longer proposed so it <br />seems unnecessary to contact State Engineer's Office. <br />EXHIBIT L <br />Rule 6.3. l2. Submission of revised Exhibit L noting barbed wire fence. <br />Fence is owned by landowner. Please see survey noting location offence in <br />proximity to section line. <br />
