6.3.3 EXHIBIT C -Mining Plan <br />Please estimate the dates that mining will commence and end (if known). If the operation <br />is intended to be an intermittent operation as defined in C.R.S. 34-32.5-103(11)(b), the <br />applicant must include a statement conforming to the provisions of this statute. <br />The mine plan map describes the existing road as a trail. Will there be improvements to <br />this road or will a new road be constructed as part of this mining operation? If there aze <br />going to be improvements, please describe them. If a new road is constructed it must be <br />included in the affected azea. <br />Also, the application indicates that no water will be used except for dust control. Please <br />identify how much water will be used (estimate) and the source of this water. <br />Please identify the primary and secondary products that will be produced, whether any <br />processing of these products will occur, and the intended use of these products. <br />6.3.4 EXHIBIT D -Reclamation Plan <br />The reclamation plan narrative indicates that all banks will be graded to 3H:1 V or flatter <br />slopes and that a retention pond will be created as a result of the mining, however, the <br />reclaimed gradients and the pond location aze not shown on the reclamation plan map as <br />required by Rule 6.3.5(3)(a) & (c). Also, please add a statement to the map indicating the <br />depth of overburden and topsoil that will be replaced. <br />With respect to retaining a pond, the State Engineer has provided comments on your <br />application indicating that if storm water is contained on site, it must infiltrate into the <br />ground or be released to the natural stream system within 72 hours of the storm event. If <br />the water is retained for more than 72 hours, an augmentation or substitute supply plan <br />maybe required. However, there may be an exemption if the pond is below a certain size <br />and meets Natural Resources Conservation Service (MRCS) design standazds. The State <br />Engineers memo is enclosed for your review. Please contact your local NRCS or Soil <br />Conservation District Office for clarification of this issue. <br />Your reclamation cost estimate appeazs to be well prepazed and is cleazly within the <br />pazameters of a typical cost estimate for an operation of this size, however, the Division <br />normally prepazes an estimate utilizing an in house bond estimating program. Upon <br />receiving responses to the above questions, which will clarify the exact fmal <br />configuration of the reclaimed azea, our office will generate a reclamation liability cost <br />estimate. At that time we will finalize the amount of financial warranty that will be <br />required in order to issue the permit. <br />6.3.5 EXHIBIT E -Map <br />See comments under Exhibits C & D. <br />
