Oe~hlte/r, Environmental Protection Specialist <br />RE: File No. M-99-070, Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy [he applicable requirements of <br />C.R.S. 34-32.5-101 et sue. and the Construction Materials Rules and Regulations of the Mined Land <br />Reclamation Board: <br />GENERAL <br />On July 15 and 16, 1999 the Division received your proof of required notices to owners of lands within <br />200 feet of the boundary of the affected land. Rule 1.6.2(1)(e)(i)(ii)requhes that these notices be mailed <br />within 10 days of filing the application with the Office. Your proof of notice to Stra[moor Hills Water and <br />Sanitation was mailed July 9, 1999. This is eighteen (18) days after your filing on June 2l, 1999. The <br />proof of notice mailing date to the other landowner within 200 feet is not legible, however, the Division <br />assumes that the mailings were made at the same time. <br />Re-notice the landowners within 200 fee[ [hat were mailed their notices late and provide [hem at least 10 <br />days notice prior to the decision date for this application. You will have to extend the decision date to do <br />so. Provide proof of these notices. <br />2. The Mining and Reclamation Plan Maps do not have the name of the applicant on them as required by <br />Rule 6.2.1(2)(a). Please provide corrected maps. <br />3. The two maps of item 2 above are not dated. Please provide maps with the dates they were prepared on <br />them. <br />EXHIBIT C -Mining Plar <br />Your item (g) for this exhibit only gives the width of the proposed haul road. It does not include <br />specifications for its construction. As a description of the haul road drainage and runoff conveyance <br />structures, you state that they are to be included in the drainage and erosion control plan. This plan could <br />not be found in the application. Please include specifications for the road construction, especially where it <br />might cross the Water and Sanitation District pipeline. Please provide the road drainage and erosion <br />control plans you refer to. (Rule 6.3.3(g)) <br />2. Your item (h) states that this will be a dry pit with no water requirement. Will you have a requirement to <br />use water to control dust? What will be the source of any such water? Rule 6.3.3(h). <br />3. Rule 6.3.3(1) requires measures that will be taken to prevent off-site damage. The Division and the El Paso <br />County Soil Conservation District are concerned about the potential for erosion on and off site and <br />sediment leaving the site. The Division is especially concerned about erosion of steep slopes outside the <br />permit area. Your plan states that "An Overlot Grading and Erosion Control Plan is designed [o prevent <br />off-site drainage problems. This plan could not be found in the application. Please address the concerns of <br />the District and the Division regarding the potential for erosion on and off site and sedimentation off-site <br />
