• <br />Action: The permittee shall install temporary sedimentation control structure(s) for the <br />spoil that is outside of drainage control and submit plans for the construction of <br />surface water control structures necessary to ensure that all disturbed drainage <br />passes through a siltation structure before it leaves the permit area. <br />Termination: RCT will modify the time for abatement from 30 days to 90 days. <br />The requested additional time is necessary for the development and <br />implementation of corrective actions and the approval of submitted plans for cited <br />area. <br />Fine Assessed: December 29, 2003, assessed fine $320. <br />Final Termination: Pending <br />WESTERN ENERGY COMPANY <br />Montana, Rosebud Mine, Permits SMP86003A, SMP840036, SMP85003C, SMP86003D, SMP81003E <br />and SMP85003P. <br />I~ <br /> <br />MSHA ID 24-01747 <br />August 18, 2000 <br />Regulatory Agency: Mohtana Department of Environmental Quality <br />Violation 00-03-01: The following deficiencies were identified in the 1999 Annual Hydrology Report: <br />a) no water level data were collected or reported for the four quarters of the <br />report year from 25 ground water monitoring sites; b) no water level data were <br />collected or reported for one to three quarters of the report year from the <br />additional 67 ground water monitoring sites; c) water quality samples were not <br />collected or reported from one ground water monitoring site (WI-181); and the <br />following from the 2000 semi-annual report: failure to collect water level data <br />from 12 ground water monitoring sites. <br />Action: a) Collecting and analyzing water quality samples from ground water monitoring <br />well WI-181 for the constituents defined in the permit (HRDV); b) obtaining <br />appropriate equipment to facilitate ground water monitoring activities outlined in <br />approved permits (i.e. water level monitoring probe for wells completed to <br />maximum anticipated well depth); c) no abatement is possible to acquire the <br />irretrievable water level measurements lost, however, to abate future problems, <br />WECo must develop and submit to the Department for approval a quality <br />assurance and quality control (C1A/QC) plan that ensures that the approved <br />monitoring plan and schedule is adhered to, and that data errors or omissions <br />are minimized in future annual and semi-annual hydrology submittals. <br />Additiorially, WECo is hereby ordered to abate the above referenced violation by: <br />conducting all future ground water monitoring in compliance with approved <br />permits. , <br />Terminated: January 26, 2001; fine assessed $340. <br />Montana, Rosebud Mine, Permit SMP840036 <br />MSHA ID 24-01747 <br />December 6, 2000 <br />Regulatory Agency: Montana Department of Environmental Quality <br />~-4 <br />2.03-9 <br />(Revised 3/6/04) <br />
