.` <br />The Applicant shall submit a financial warranty in the amount of <br />$276,700.00. <br />The operator will monitor two of the 15 individual or multiple spring <br />sources that were mapped by Azurite, Inc.and located on the north side of <br />the Arkansas River on asemi-annual basis for flow rate fluctuations and <br />include the results of the monitoring with its Annual Report. If a <br />significant flow rate decrease is observed which is above 20% and not <br />associated with a dry season for the region, the operator shall promptly <br />investigate the cause of the drop in flow rate and promptly submit a report <br />of it's findings to the Division. In addition, the Operator shall measure the <br />two monitoring wells located along the southern boundazy of the permit <br />azea for static water elevation on asemi-annual basis and include those <br />measurements in its Annual Report. The Operator shall promptly <br />investigate any significant drop in static water elevation that is not <br />associated with seasonal conditions and promptly submit a report of the <br />results of the investigation to the Division. <br />To address the concerns about potential contamination from chemical <br />methods used by the operator for weed control, the Operator shall conduct <br />water quality tests along with the monitoring of the wells and springs <br />provided for in this condition. The Division of Minerals and Geology will <br />develop for the operator a list of the water quality parameters the operator <br />will be required to test. The parameters will be limited to those associated <br />with the operator's use of herbicides in implementing it's noxious weed <br />(leafy spurge) management plan. <br />The bentonite clay liner of the fuel storage azea will be compacted to a <br />permeability of 1 x 106. Prior to placement of the gravel liner, the <br />operator shall submit for the Division's approval the results of four (4) <br />evenly spaced permeability tests of the liner. The tests shall be performed <br />by a certified geotechnical engineer. <br />4. The operator shall report any significant fuel spills outside the <br />containment azea to the Division within 24 hours of the spill. The operator <br />shall send to the Division, as soon as practicable, a report on the mitigation <br />of any potential pollution of the ground water system due to the spill. <br />[n the same manner as provided for the testing of quantity and quality of <br />the two (2) springs defined in Condition No., 1, the operator shall test the <br />Mark N. And Jacque Brown/Robert and Susan Steers spring located east <br />of County Road 157 on a bi-annual basis, provided the owners and users <br />of the spring provide sufficient and reasonable access to allow the operator <br />to conduct the sampling necessary for the water quality test. <br />
