<br />1. Pursuant to § 34-32.5-112. C.R.S., Agile Stone Systems, Inc. filed an <br />application for a reclamation permit for its Parkdale gravel, granite, and sandstone mining <br />operation. <br />2. Pursuant to § 34-32.5-114, C.R.S., timely objections to the application were <br />filed by several entities. <br />3. In accordance with Construction Material Rule 1.4.5(5) and (6), 2 CCR 407-4, <br />the Division of Minerals and Geology recommended approval of the applications on <br />certain conditions. <br />4. The testimony, exhibits, and legal azgument presented by the Applicant and the <br />Division aze credible and persuasive on the issues considered by the Board as set forth in <br />the Hearing Order. <br />5. Based on the testimony, exhibits, and legal azgument presented by all the <br />parties, the Boazd determined that the application should be granted on the conditions set <br />forth herein. <br />CONCLUSIONS OF LAW <br />1. The Boazd's authority to review an application for a permit is set forth in § § <br />34-32.5-115(4) and 34-32.5-116, C.R.S. (1997). <br />2. The Agile Stone Systems, Inc., Application meets the requirements of § § 34- <br />32.5112, 34-32.5-115(4) and 34-32.5-116, C.R.S. (1977) and applicable Construction <br />Material Rules and Regulation, 2 CCR 407-4. <br />3. Because the Applicant's application conforms to the requirements set forth <br />above and fwther because the Applicant has agreed to comply with the terms of the <br />conditions and stipulations set forth below and incorporated into this Order as conditions <br />upon which the application is granted, the Board has no grounds upon which to deny the <br />application. <br />The following conditions and stipulations aze incorporated into and made a part of <br />this Order: <br />
