-~ ~ • <br />ORDER <br /> <br />The Board of County Commissioners of Elbert County, Colorado, <br />at a public hearing held on February 26, 1982, at the hour of <br />11:3 o'clock a.m. reviewed and took testimony concerning an ap- <br />plication for authorization to operate an open pit gravel mine <br />submitted by Robert D. Miller and Beverly R. Miller. <br />A review of the application discloses that the application <br />was filed with the Land Use Department on February 10, 1982. The <br />application contained all attachments required under the special <br />use review provisions of Section 12 of the Elbert County Official <br />Zoning Regulations. Publication of the Notice of the hearing <br />for consideration for said application was published once on a <br />date which was subsequent to ten days after the filing of said <br />application and prior to the date of the hearing, and that the <br />required notices to adjoining landowners were properly mailed <br />fourteen days prior to the date of the hearing. <br />Testimony was taken both from the applicant and from citi- <br />zens who appeared at said hearing. Exhibits were duly marked and <br />admitted and the Board, being fully advised in the premises, does, <br />as required by Section 12.2 of the Elbert County Official Zoning <br />Regulations, make the following findings: <br />1. That the applicant has complied with all the public <br />notice and public hearing procedures as specified in Section XVIII, <br />as amended, of the zoning regulations. <br />2. The Board has considered the unique conditions of the <br />surrounding neighborhood, if any; the county-wide need for such <br />use; the effect of truck traffic to and from such use; the effect <br />of same concerning creation of hazards in developed residential <br />and resort areas; and possible damage to public roads. The appli- <br />cant has provided a satisfactory general rehabilitation plan for <br />the lands affected by the open pit gravel mining operation. <br />Having considered all of the evidence and the required <br />regulatory factors, the Board of County Commissioners of Elbert <br />County enters the following order: <br />Order <br />1. Permission is hereby granted to the applicants, Robert <br />D. Miller and Beverly R. Miller, their managers, operators, lessees <br />or subsequent grantees, permission to operate an open pit gravel <br />mine, legally described as follows: <br />A tract of land in Section 28, Township 6 South, <br />Range 64 West of the 6th P.M., County of Elbert, <br />State of Colorado, more particularly described as <br />follows: <br />
