The Division of Minerals and Geology has completed its preliminary adequacy review of
your 110-construction materials reclamation permit application. The application was
received on June 1, 2006 and called complete for review on June 22, 2006. The decision
date for this application is July 24, 2006. Please be advised that if you are unable to
satisfactorily address any concerns identified in this review before the decision date, it
will be your responsibility to request an extension of the review period. If there are
outstanding issues that have not been adequately addressed prior to the end of the review
period, and no extension has been requested, the Division will deny this application.
The review consisted of comparing the application content with specific requirements of
Rule 6.1, 6.2, 6.3, and 6.5 of the Minerals Rules and Regulations of the Colorado Mined
Land Reclamation Board for the Extraction of Construction Materials. Any inadequacies
are identified under the respective exhibit heading along with suggested actions to correct
them.
6.3.1 EXHIBIT A -Legal Description and Location Map
(1) The legal description is adequate as submitted, however, there is a
discrepancy with the proposed number of acres to be affected. The cover page
of the application and Exhibit A both state 9.9 acres will be disturbed and the
dimensions included on the map prepared by Walt Isenbart identifies the area
as 9.0 acres. Also, is the haul road pre-existing or should it be included as part
of the affected area. Please review and submit the correct amount of acreage
to be included as affected area.
