Please find enclosed <br />additional data confirming our obligations under the subject permit applica- <br />tion regarding concerns you expressed toward drainage, topsoil and slope <br />stabilization. We have finished our drilling and mineral evaluation work and <br />have requested approval of a rehabilitation plan submitted to the BLM this <br />week. This must be approved and initiated before our Plan of Operation <br />review period can be started. <br />Regarding drainage, our analysis indicates the 60,000 gal capacity gully <br />check (sedimentation control) as shown on our Initial Mining Plan (see <br />Exhibit Two) is more than adequate to control impacts of the mining operation. <br />Existing drainage area impacting this gully check may be increased 3 to 4 <br />acres due to topographical modifications from our mining operation. The in- <br />crease from 10 to say 14 acres will still be facilitated by the check pro- <br />posed, in our opinion. We also expect to install a new 24" diameter culvert <br />in the bottom of the draw to serve as an overflow control from the sedimen- <br />tation pond. However, in conjunction with BLM review of our Plan of Operation, <br />final sizing changes of both the sedimentation pond and the culvert may be <br />required by the BLM prior to approval of our plan. You will be advised of <br />final determination upon completion of their review and acceptance of this <br />plan. Additional gully checks will be constructed, as necessary, to protect <br />crushing, screening and conveying equipment locations and to protect stock- <br />pile areas. Any of these additional structures will be located and described <br />in our annual reports and they should only beneficially impact reclamation <br />costs. <br />The BLM has also expressed concern regarding construction correlation with <br />both Town of Gypsum and Eagle Valley Telecommunications Co (copy of receipt <br />of notification to Eagle Valley Telecommunication is enclosed). We have been <br />in contact with both entities and will document to BLM accords reached with <br />both parties prior to any mining. Please advise if you would like results of <br />these agreements also. <br />
