~• :~• <br />This agreement and any State, County, or Municipal permits <br />obtained by the Company are the property of the Company for its <br />use as it sees fit. <br />The Company agrees to provide liability insurance and shall <br />be responsible for all operations related to mining of the property. <br />Payment for materials removed will be made to the Owner(s) <br />within ten (10) days after payment is recieved by the Company. <br />The terms hereof shall be binding upon and insure to the <br />b•°nifit of the heirs, executors, administrators and assigns of <br />the respective parties hereto. <br />SPECIAL CONDITIONS: <br />The Company will obtain all I~ILR3 permits and make applications <br />for County Special Use permits in owner's name. Owner hereby designates <br />the Company as his agent in matters relating to obtaining such special <br />u:~e permits. <br />Owner is hereby given grazing rights to propezty owned by <br />Southwest Ready Mix,Inc.of Pueblo in Pueblo County as partial <br />consideration of royalities. Value of such rights shall be considered <br />to be 52,000.00 per year and royalities shall be applied to the value <br />of the rights. If the Company removes less than 5714.29 tons in any <br />year then the owner will still receive grazing privilages as minimum <br />compensation. <br />This lease is not assignable without owner's permission- <br />The owner will make available such water recourses aviilable <br />at the site that might be required by Company operations as long <br />as water is excess to owner's requirements. <br />Dust control shall be Company's responsibility. <br />~, <br />Page 2 of 3 <br />
