Box 258 <br />Avondale, CO 31025 <br />and <br />Sout <br />Construction Co; Inc. <br />whose address is 117 White Pine Drive, Alamosa, CO 41101 <br />hereinafter referred to as the Company. <br />WITNESS That the Owner(s) for the consideration of One <br />and no/100 Dollars (5 1.00 ) and further agreements hereby lease <br />to the Company an exclusive option for the purpose of purchasing, <br />pr~~cessing, producing, and removing such material located on land <br />described as follows: <br />Portions of Sections~~24 and 25 T.21 S., <br />R. 61W. and Section 30, T. 21 S.1~JC. 60 W. 6th P.M. <br />in Pueblo County amounting to 35'~a~cres more or less as <br />shown on Exhibit "A". Access shall be on existing private <br />roads. <br />The Company desizes to purchase any material located on the <br />above desczibed land, for which the Owner(s) will be paid a <br />royalty fee for removed materials at the following rate: <br />Aggregate products at Thirty-five (50. 35) per ton. <br />Aggregate products at i ty-cwo ($0. 52) per cubic <br />yard. <br />This Lease Agreement With Option to Buy Material shall <br />conmience on the date of this agreement and remain in force for <br />a term of Five <5) year(s), terminating on the .~,),Ja~day of <br />_,lune A. D., 19 94 at 12:00 noon. <br />The Company and its authorized associated contractors shall <br />have the right of ingress and egress to and from the subject premises <br />and to erect any temporary structures, such as screening, <br />cru~,'hing, and/or asphalt or concrete plants; to stockpile material <br />in an area of sufficient size; and to employ any reasonable methods <br />for the removal of said material. <br />Page 1 of 3 <br />
