This special use permit does not substantially modify that intent. The concept of zoning underlying "special use" or •use-by-review" is that such uses are not inherently inconsistent with the "principal uses" or "uses-by-right" of the zone district. However, a specific use-by-review may not be appropriate at all locations throughout the zone district. Therefore, the Planning Commission is given the opportunity to consider the compatibility of the use with surrounding uses. The Commission may also impose reasonable conditions to ensure consistency with the character of the area and to minimize impacts. (c) This Special Ose proposal incorporates reasonable means to create an environment harmonious with that of the surrounding properties. • The proposed mining operation will be monitored by the Mined Land Reclamation Board and Colorado Department of Health (air quality) to insure that the operation remains harmonious with the surrounding environment. (d) The Special Ose rill not adversely affect the public health, safety, or relfare. • The operation will be located in a remote area and on private property. Therefore, staff does not feel that this special use permit will have a negative effect on the public's health, safety, or welfare. OTHER F~F.RMITS The apF~licant will be required to obtain an Emissions Permit from the Colorado Department of Health, a Mining Permit rom the Mined Land Reclamation Board, and a State Highway Access Permik from the Co]orado Department of Highways.
