<br />Memo to PCPC <br />SUP 6E'4 <br />July ]7, 1989 <br />Page E'our <br />• This special use permit does not modify the Land <br />Use plan. The intent, purpose, and spirit of <br />the Pueblo County Zoning Resolution in the A-1 <br />Zone District s ..to retain and promote the <br />appropriate use of .dry range and irrigated lands <br />and encourage open use of the land in keeping <br />with its natural characteristics and <br />agricultural function." This special use permit <br />does not substantially modify that intent. The <br />concept of zoning underlying "special use" or <br />•use-by-review" is that such uses are not <br />inherently inconsistent with the "principal <br />uses" or "uses-by-right" of the zone district. <br />However, a specific use-by-review may not be <br />appropriate at all locations throughout the zone <br />district. Therefore, the Planning Commission is <br />given the opportunity to consider the <br />compatibility of the use with surrounding uses. <br />The Commission may also impose reasonable <br />conditions to ensure consistency with the <br />character of the area and to minimize impacts. <br />(c) This Special Ose proposal incorporates reasonable <br />means to create an environment harmonious with that <br />of the surrounding properties. <br />• The proposed mining operation will be monitored <br />by the Mined Land Reclamation Board and Colorado <br />Department of Health (air quality) to insure <br />that the operation remains harmonious with the <br />surrounding environment. <br />(d) The Special Ose rill not adversely affect the <br />public health, safety, or relfare. <br />• The operation will be located in a remote area <br />and on private property. Therefore, staff does <br />not feel that this special use permit will have <br />a negative effect on the public's health, <br />safety, or welfare. <br />OTHER F~F.RMITS <br />The apF~licant will be required to obtain an Emissions Permit from <br />the Colorado Department of Health, a Mining Permit rom the Mined <br />Land Reclamation Board, and a State Highway Access Permik from <br />the Co]orado Department of Highways. <br />
