All the areas within the flood plain <br />will be used as "open space" for wildlife, conservation and recreation <br />purposes. <br />B-1 The lease with the operator requires that all operations be in accor- <br />dance with the Reclamation Act, its rules and regulations, terms and <br />conditions of tfre bond and any permits issued, Physical inspections <br />by the owner and the governing agencies will he used to verify compliance. <br />The "Excepted Parcel" is as shown on the Flining Plan. It is a parcel <br />of gr•uund conveyed to the B. H. Eaton Ditch Co, in Warranty Deed recorded <br />in Book 688, Page 368, December 28, 2922. It is used by the ditch com- <br />pany for the Ditch Headgate controls and measuring devices. Access will <br />continue to be provided for this use. <br />B-2 Attached is a list of the parties notified through the County Referral <br />process. All the ditch companies, pipeline companies and utility com- <br />panies affected were notified. Sinclair Pipeline and A.T.& T, made the <br />only response and they indicatd "No Conflict". We feel that the owners <br />of improvements are adequately covered against damages throuyh the oper- <br />ators insurance and the courts, however, we will p~Fsue an agreement <br />with the affected parties regarding "adverse effect on man made structures <br />within 200 feet:'. <br />C-1 A 100 foot buffer zone from the "bank full" river can he maintained <br />and will be shown on the final Mining Plan. <br />1 <br />
