<br /> <br />EXHIBIT A - Legal De_ciQt`r~l/~~.. <br />That portion of the 1NE~1/4 of Section 19, T9N, R45W of the 6th <br />P.M. in Phillips County, Colorado which lies in very northwest <br />corner of said quarter. Said pit covers approximately 5 acres. <br />EXHIBIT B - Mining Plan <br />Access to the pit area is currently available from Phillips <br />County Road number 44. There is an existing trail to the <br />excavation area. This trail will not be improved, but simply used <br />as it exists. <br />Sand and gravel will be mined from an area which in years past <br />was used as a gravel pit by Sedgwick County to the north, local <br />farmers, and Phillips County. The existing pit will simply be <br />expanded as gravel is needed for local road operations and as the <br />supply remains available. Gravel will be mined up to 20 feet in <br />depth. <br />As the pit expands into new lands, the area to be mined will be <br />stripped. The existing topsoil is about 4 inches deep. This <br />topsoil will be stockpiled in the bottom of the existing pit area <br />for later use in reclamation. <br />Stockpiling, for the most part, will not occur, as most of the <br />gravel will simply be used as it is mined. If it is stockpiled, it <br />will be done on the floor of the existing pit. Since there is no <br />topsoil in this area now, the stockpile area will not be stripped. <br />The pit will be operated annually. The supply is undetermined, <br />but it is expected to last an indefinite time because of the <br />limited use of the pit. <br />
