Box 147 <br />Fort Garland, Colorado 81133 <br />Re: Powell Construction Company Pit <br />Our File No. 77-53 <br />Dear Mr. Powell: <br />I have reviewed our file for the above-captioned operation after my visit to <br />the site and my~conversation with you. Although the assignment form for the <br />52,500.00 certificate of deposit is in the file, the permit itself is still <br />incomplete. I have enclosed several items to assist you in finishing up the <br />permitting process: ~1) Two copies of our 110, limited impact mining and <br />reclamation permit application forms; 2) My inspection report on the op<~ration; <br />3) A copy of our reclamation bond form for use with a certificate of deposit; <br />and 4) A copy of Rade Orell's letter of August 29, 1978 to your father de- <br />tailing the items still needed for completion of the permit application. I <br />will elaborate on some of these items below. I suygest that you send our <br />Division a request for a copy of our Rules and Regulations with a check for <br />52.00 made out to "Mined Land Reclamation". For now, the brief outline of <br />exhibits on the back of the permit form should help you get started on this <br />process. <br />Durinq our future conversations about the permit, you will need to submit an <br />estimate of your costs for reclamation. These will be reviewed by me, and you <br />and I will come to an agreement as to what is a fair bond amount. As of July 1, <br />1981, the legislature raised the maximum amount of bond for a limited impact <br />permit to 55,000.00. Also, we now use a new bond form with certificates of <br />deposit and require that the certificate of deposit also be sent, with the form, <br />to our Division for deposit in the State Treasurer's vault. This leads to <br />the conclusion that a new bond will probably be set by the Board when the <br />permit is approved, and thus the existing 52,500.00 bond will be replaced. <br />Please read my inspection report carefully, since I have noted a few potential <br />problems with the site that should be accounted for in your further submissions <br />to the Division. Call me if you need any clarification of any portions of <br />the report. <br />
