<br />to enter the White Marble #2 Claim, however, is still not settled. The commitment you have made to restrict your <br />operation and not affect this claim until you have obtained ownership, and provided proof of such to this office, has <br />been reviewed and approved by our agency's legal counsel at the attorney general's ofFce. Please be aware that <br />this restriction will be extended to include any mining-related activity. Any surface operations carved out under <br />this proposed permit must be contained within the London Lode Claim, until such time that you have provided <br />proof of holding the deed conveying right to enter for purposes of mining and reclamation. Language to this effect <br />will become part of your permit document. Activities included in this restriction include equipment or vehicle <br />traffic and parking, power generation, storage of parts or fuel, topsoil stripping or tree cutting in anticipation of <br />expanding the mining, stockpiling of topsoil or product, waste dumping, road construction or maintenance, and <br />other activities clearly carved out as part of the mining operation. <br />Exhibit L -Permanent Man-made Structures <br />There is a commonly acknowledged number of pre-existing features at this mine site, some of which may not be <br />stable or in reclaimed condition. The applicant has stated that unstable areas within the proposed permit area will <br />not be re-affected until they are made stable or functional. These areas mainly refer to the waste slope and <br />sediment pond. There are three issues to be clarified here: 1) that Sierra's operation will depend on the stabilizing <br />work to be tamed out on these areas, in order for the operation to truly reach its full potential; 2) who is the party <br />who is responsible for performing such stabilizing work; and 3) that there needs to be either a damage agreement <br />or engineering evaluation for potential damages to structures within 200 feet of areas to eventually be re-affected by <br />the new operator. <br />(it may not be the case that this agency is the responsible party for performing or funding the remediation of <br />damaged areas inside the permit boundary. Areas offsite must be considered differently, and might be fully <br />available for forfeited bond funds.) At this time, however, in the application period for the new permit, the operator <br />should ensure that all structures which may potentially be affected be identified, and evaluated for that damage <br />potential. Please provide all appropriate documentation needed for this exhibit. <br />Other Items <br />As new application-related material is added to the file, originating from any party, please ensure that all of it is <br />filed for public review in a timely manner with the Gunnison County Clerk and Recorder. We must have proof of <br />all such additional filings prior to the Division's decision. <br />The Division's decision date is now set for 7/30/99. Please be reminded that if all adequacy issues are not <br />addressed satisfactorily by the time of the decision date, and the decision date is not extended, the application may <br />be denied. <br />I look forward to resolving these final adequacy issues and to your next adequacy submittal.
