9. Moffat County does not anticipate the interception of ground water at this facility. <br />If water is encountered, it will be impounded, and the State Land Board will be <br />notified and advised to address the applicable provisions of the State Water Laws. <br />10. Berms and ditches will be used as necessary to divert surface run-off water away <br />from the pit areas. <br />I I. This reclamation plan includes the flexibility to develop low areas within the <br />excavation area to control local surface water. If these low areas collect a <br />substantial amount of water for an extended period of time, The State Land Board <br />will be notified. <br />12. Local access roads will be developed for the construction and mining of this <br />facility.
