u <br />Section 744.11 (b) Continued. <br />Director in consultation with the Mining Supervisor, set and cement <br />casing in the hole and install suitable blowout prevention equipment. <br />No drilling will be conducted on lands that are potentially valu- <br />able for oil, gas or geothermal resources. <br />(c) Use of wells by others. Upon receipt of a written request from the <br />surface owner or the appropriate authorized officer, the Regional Dir- <br />ector, in consultation with the Mining Supervisor, may approve the <br />transfer of an exploratory well for further use as a water well. Ap- <br />proval of the well transfer shall be accompanied by a corresponding <br />transfer of responsibility for any liability for compliance with the <br />Act, this Chapter, damage from use or maintenance of the well and even- <br />tual plugging. Nothing in this Paragraph shall supersede or affect the <br />applicability of any State law with respect to that transfer. No person <br />engaged in exploration shall be relieved of responsibility for explora- <br />tion wells except to the extent set forth in an approval granted under <br />this Paragraph. <br />No transfer of an exploration hole to a use as a water well is <br />planned. However, in the event such a transfer is needed, it will <br />only be done with the approval of the Regional Director of OSM and <br />the Area Mining Supervisor of USGS.
