Mr. Gillis stated that BLM's previous request to withdraw from party status <br />did not constitute withdraw of the objection to the application. <br />Mr. Yeager stated that he was representing the Delta County Commissioners and that the <br />Commissioners were opposed to the approval of the application. Mr. Yeager stated that <br />the Commissioner's objection to the application was limited to a traffic safety issue <br />located at the intersection of County Road J-50 and Highway 92. Mr. Yeager stated that <br />due to the high speed of the traffic on Hwy 92 (65 mph) and the alignment (curve) of <br />Hwy 92 at the referenced intersection, the Commissioners were concerned that the gravel <br />trucks from the proposed operation needed an acceleration and deceleration lane to safely <br />access Hwy 92 from County Road J-50. Mr. Yeager stated that the absent acceleration <br />and deceleration lane for Hwy 92 was the only objection issue to the application that the <br />Commissioners had identified. <br />Mr. Gillis clarified for the Delta County Commissioners, that their traffic safety issue did <br />not appear to be addressed by the Construction Materials Act and Rules, and therefore <br />appeared to be anon-jurisdictional issue for DMG and the Colorado Mined Land <br />Reclamation Board. Mr. Gillis stated that DMG had not received a written statement of <br />opposition to the approval of the application from the Commissioners, and that Delta <br />County must submit their written objection to the application within five (5) working days <br />from today, the date of the Informal Conference. <br />Mr. Yeager indicated that he would submit a written statement of opposition to the <br />approval of the application within the five day deadline. Mr. Yeager also indicated that if <br />the Applicant could reach an agreement with the Commissioners, to resolve the traffic <br />safety issue, Delta County would withdraw their objection to the approval of the <br />application. Mr. Yeager indicated that the Commissioners had scheduled a meeting with <br />the Applicant, for August 3, 2000, to attempt to resolve the traffic safety issue. <br />No additional issues were raised during the Informal Conference. <br />
