•' ,
application. Mr. Gillis stated that BLM's previous request to withdraw from party status
did not constitute withdraw of the objection to the application.
Mr. Yeager stated that he was representing the Delta County Commissioners and that the
Commissioners were opposed to the approval of the application. Mr. Yeager stated that
the Commissioner's objection to the application was limited to a traffic safety issue
located at the intersection of County Road J-50 and Highway 92. Mr. Yeager stated that
due to the high speed of the traffic on Hwy 92 (65 mph) and the alignment (curve) of
Hwy 92 at the referenced intersection, the Commissioners were concerned that the gravel
trucks from the proposed operation needed an acceleration and deceleration lane to safely
access Hwy 92 from County Road J-50. Mr. Yeager stated that the absent acceleration
and deceleration lane for Hwy 92 was the only objection issue to the application that the
Commissioners had identified.
Mr. Gillis clarified for the Delta County Commissioners, that their traffic safety issue did
not appear to be addressed by the Construction Materials Act and Rules, and therefore
appeared to be anon-jurisdictional issue for DMG and the Colorado Mined Land
Reclamation Board. Mr. Gillis stated that DMG had not received a written statement of
opposition to the approval of the application from the Commissioners, and that Delta
County must submit their written objection to the application within five (5) working days
from today, the date of the Informal Conference.
Mr. Yeager indicated that he would submit a written statement of opposition to the
approval of the application within the five day deadline. Mr. Yeager also indicated that if
the Applicant could reach an agreement with the Commissioners, to resolve the traffic
safety issue, Delta County would withdraw their objection to the approval of the
application. Mr. Yeager indicated that the Commissioners had scheduled a meeting with
the Applicant, for August 3, 2000, to attempt to resolve the traffic safety issue.
No additional issues were raised during the Informal Conference.
