Lafarge is currently working with EI Paso County <br />and CDOT to assure proper access. <br />5. A Bureau of Land Management permit is not necessary as the subject <br />property is on private land. <br />6. Lafarge submitted a Special Use Permit application to EI Paso County on <br />October 4, 2006. We are currently addressing adequacy comments with <br />the County. <br />Exhibit S: <br />The applicant has undertaken efforts to comply with Rule 6.4.1, concerning <br />permanent man-made structures. Compliance with be demonstrated through <br />notarized agreements, and, where agreement cannot be obtained, a <br />geotechnical engineering evaluation will be furnished to the DRMS. These <br />efforts are on-going as of this writing and should be completed prior to the March <br />2 decision date. <br />For the record, the various utilities and transportation structures on the map of <br />the area are largely over 200 feet - or near the limit of 200 feet -from the <br />proposed excavation. Typically, detailed geotechnical modeling and evaluation <br />is not necessary to establish a lack of adverse structural impact from access <br />roads and stockpiles. In addition, the applicant attached a notarized affidavit to <br />the original submittal of Exhibit S, agreeing to keep the affected area of the <br />operation at lease 200 feet from all permanent man-made structures until Rule <br />6.4.19 is addressed with respect to those structures. The applicant is committed <br />to limiting mining impacts appropriately until the safety of each structure is <br />adequately addressed. <br />This adequacy response is submitted in advance of the March 2, 2007, DRMS <br />decision date for the M-2006-073 application. Our intent, on behalf of Lafarge <br />West, Inc., is to provide the Division with ample opportunity to review these <br />comments and deem a significant number of adequacy issues resolved prior to <br />the decision date. In the meantime, we will continue to develop with Lafarge <br />responses to the limited outstanding adequacy issues noted above. We will <br />submit additional correspondence to the DRMS at the soonest opportunity and <br />look forward to the Division's confirmation that various items from the DRMS <br />Adequacy Review 01 have been fully addressed. <br />
